Spixal Creator & Affiliate Program Terms

These Terms govern participation in the Spixal Creator & Affiliate Program ("Program"). By applying to or participating in the Program, you agree to the following terms.

Spixal reserves the right to update these Terms at any time.

1. Program Overview

The Spixal Creator & Affiliate Program allows approved creators and partners ("Affiliates") to earn commission by referring customers to purchase products from Spixal.

Affiliates receive a unique referral link and/or discount code which can be shared with their audience.

Commission is paid on qualifying purchases made through the affiliate’s link or code. During store-wide promotions or sales events, commission rates may be temporarily adjusted to reflect promotional pricing. Participation in the Program is subject to approval by Spixal.

2. Commission Structure

Commission is calculated on the net order value (excluding taxes, shipping, refunds, and discounts unless otherwise specified).

Affiliate commission tiers are based on monthly referred sales:

Starter - $0 – $499 - Earn 4%

Growth - $500 – $1,999 - Earn 6%

Top - $2,000 – $4,999 - Earn 8%

VIP - $5,000+ - Earn 11%

Spixal reserves the right to review and adjust commission tiers or eligibility at any time.

VIP tiers may be granted, adjusted, or removed at the discretion of Spixal.

3. Tracking & Attribution

Affiliate referrals are tracked using:

• unique referral links

• unique affiliate discount codes

• cookies stored on the customer’s browser

Cookie duration is 30 days.

If a customer makes a purchase within this period using the affiliate link or code, the sale will be attributed to the affiliate.

Where multiple affiliates refer the same customer, attribution will be determined by Spixal’s tracking system.

4. Payout Terms

Affiliate commissions are paid under the following conditions:

• Minimum payout threshold: $30 AUD

• Payments are made monthly

• Only approved and completed orders qualify for commission

• Commissions on refunded, cancelled, or fraudulent orders will be void

Spixal may withhold or adjust payouts where returns or chargebacks occur.

Affiliates are responsible for providing accurate payment details.

Payments are made via PayPal, it's your responsibility to provide an accurate PayPal account to receive payment.

5. Discounts & Promotional Codes

Affiliates may receive a unique discount code to share with their audience.

Discount codes:

• may only be used as intended for promotional purposes

• must not be listed on coupon websites without permission

• must not be misrepresented as official store-wide promotions

Spixal reserves the right to disable codes that are misused.

6. Product Seeding Program

Spixal may provide free or discounted products to selected creators as part of its Creator Seeding Program.

Participation in seeding programs is optional and subject to approval.

Products provided through seeding programs are intended for the purpose of:

• product testing

• content creation

• sharing honest experiences with audiences

Receiving seeded products does not guarantee payment or commission.

Spixal may request that seeded creators share content demonstrating how the product is used.

Creators participating in seeding programs agree to comply with relevant advertising disclosure guidelines.

7. Content & Advertising Guidelines

Affiliates agree to promote Spixal in an honest and responsible manner.

Affiliates must:

• comply with Australian consumer law and advertising guidelines

• clearly disclose affiliate relationships where required (e.g. “affiliate link”, “ad”, or “sponsored”)

• represent products accurately

Affiliates must not:

• make false claims about products

• engage in misleading advertising

• impersonate Spixal or act as an official representative of the brand

8. Prohibited Activities

The following activities are not permitted:

• self-referrals (purchasing through your own affiliate link or code)

• commission abuse or fraudulent transactions

• posting affiliate links on coupon websites without permission

• brand bidding on paid search ads using the Spixal name

• using spam, bots, or automated traffic

Any violations may result in:

• withheld commissions

• removal from the Program

• termination of the affiliate account

9. Intellectual Property

Affiliates may use approved Spixal images, product photos, and branding materials provided within the Creator Kit.

Affiliates may not:

• modify trademarks or logos

• create websites or social media accounts impersonating Spixal

• represent themselves as employees or official brand representatives

All Spixal intellectual property remains the property of Spixal.

10. Program Termination

Spixal reserves the right to suspend or terminate any affiliate account at any time if:

• these Terms are violated

• fraudulent activity is detected

• the affiliate promotes the brand in a manner that may harm the brand’s reputation

Upon termination:

• unpaid commissions may be cancelled if violations occurred

• affiliate links and codes will be deactivated

11. Limitation of Liability

Spixal is not liable for:

• tracking errors

• website downtime

• technical issues affecting affiliate links

• indirect or consequential damages related to participation in the Program

Participation is at the affiliate’s own risk.

12. Changes to the Program

Spixal may modify the Program at any time, including:

• commission rates

• payout terms

• tracking methods

• program rules

Affiliates will be notified of significant changes where possible.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes arising from participation in the Program will be subject to the jurisdiction of the courts of New South Wales.

14. Content Usage Rights

By participating in the Program, affiliates grant Spixal permission to repost or share publicly available content featuring Spixal products for marketing purposes, including on social media, advertising, and the Spixal website.

Credit will be provided where appropriate.
