Terms & Conditions for The Ministry of Outdoor Education (MOE) Affiliation Scheme

1. Introduction

This Affiliation Scheme Agreement (“Agreement”) governs the relationship between The Ministry of Outdoor Education (“MOE”, “we”, “us”) and participants (“Affiliates”, “you”) in our Affiliation Scheme. By enrolling, you agree to comply with these terms.

2. Definitions

• Affiliate: An individual/entity promoting MOE’s services via the Scheme.
• Affiliate Link: A unique URL tracking referrals.
• Commission: A 5% credit (of the net purchase price) earned per qualifying sale.
• Net Purchase Price: The amount paid by a customer after applying their 5% discount.
• Credit: Non-transferable, non-monetary value until cashed out.

3. Enrolment

3.1 To join, applicants must be contacted directly or submit a request via email or through MOE’s website and agree to these terms.

3.2 MOE reserves the right to approve/reject applications at its sole discretion.

4. Affiliate Responsibilities

4.1 Promotional Compliance:

• Use only MOE-approved branding and adhere to Brand Guidelines.
• Place Affiliate Links prominently at the bottom of your website/platform.
• Disclose your affiliate relationship per FTC/ASA guidelines.

4.2 Prohibited Actions:

• No spam, fraudulent activity, or misleading claims.
• No unauthorised use of MOE’s intellectual property.
• No use of Google Ads, Meta ads or other PPC activity to promote the affiliate link is permitted. Affiliates found to be including their links within paid ads are liable to be terminated.

5. Commission Structure

5.1 For each purchase via your Affiliate Link:

• The customer receives a 5% discount at checkout.
• You earn a 5% Credit (based on the net purchase price).
• Orders over £5000 placed via a trackable affiliate link are eligible for 10% commission. This tier will automatically be applied.

5.2 Credits:

• Accumulate in your MOE account.
• No monetary value until cashed out.
• May be used as credit toward MOE services or cashed out (processed every 90 days).
• Expire if inactive for 12 months.

6. Payment Terms

6.1 Payouts:

• Processed every 90 days via BACS. You must make sure you submit correct payment information to your account upon sign up.
• Minimum cash-out threshold: £20 (credits below this roll over).
• Taxes: You are responsible for declaring/paying taxes on earnings.

7. Tracking & Reporting

7.1 MOE’s tracking system governs all referrals. Disputes must be raised within 14 days of transaction.

8. Termination

8.1 By MOE: We may suspend/terminate your participation immediately for:

• Breach of this Agreement.
• Fraudulent activity.
• Brand misuse.
• PPC promotion of an Affiliate link

8.2 By You: Terminate with 30 days’ written notice.

8.3 Effect of Termination:

• Unpaid Credits are forfeited if terminated for breach.
• Lawful termination entitles you to pending payouts.

9. Intellectual Property

9.1 Limited license to use MOE’s branding only as permitted herein.

9.2 All rights revert upon termination.

10. Liability

10.1 MOE is not liable for indirect losses arising from the Scheme.

10.2 Affiliates indemnify MOE against claims related to their promotions.

11. Modifications

MOE may update these terms at any time. Continued participation constitutes acceptance.

12. Governing Law

This Agreement is governed by the laws of England and Wales.
