iTap Affiliate Program Terms of Service

1. Introduction & Acceptance


Welcome to the iTap Affiliate Program (“Program”). These Terms of Service (“TOS”) are a legal agreement between you (the “Affiliate”) and iTap (“Company,” “we,” “us,” or “our”), located in New Jersey. By signing up or participating in this Program via links on itapshop.com or myitap.com, you acknowledge that you have read, understood, and agree to be bound by these TOS. If you do not agree, you must discontinue use of the Program.


2. Definitions


  • “Affiliate”: Any individual or entity applying to or participating in the iTap Affiliate Program.
  • “Program”: The iTap Affiliate Program described in these TOS.
  • “Products”: NFC products (including tags, accessories, and digital exchange items) offered by iTap via itapshop.com.
  • “Affiliate Link”: A unique URL or code provided by iTap to the Affiliate for tracking referrals and sales.
  • “Commission”: The monetary compensation earned by the Affiliate for qualifying sales, as further detailed in these TOS.


3. Program Sign-Up & Approval


  1. Eligibility
  • There are no specific age or geographic restrictions to join the Program.
  • By submitting an application, you represent that the information you provide is true and accurate.
  1. Application Process
  • Prospective affiliates can apply through links at itapshop.com or myitap.com.
  • All applications are subject to automated approval based on basic criteria set by iTap.
  1. Right to Refuse or Revoke
  • We reserve the right to decline or revoke an Affiliate’s participation at any time if we deem an Affiliate’s activities inappropriate, unethical, or harmful to our brand.


4. Affiliate Responsibilities & Conduct


  1. General Conduct
  • Affiliates are expected to preserve the positive reputation of iTap.
  • Any actions that negatively impact our brand, such as bashing our name or engaging in unethical behavior, may result in termination.
  1. Promotional Methods
  • Affiliates may use any promotional channel, provided it is ethical and does not harm iTap’s reputation.
  • No promotion via discount or coupon sites is permitted.
  1. Brand Usage
  • Affiliates may use iTap trademarks, logos, and name in promotional materials solely for the purpose of promoting iTap and referring sales to our websites.
  • Affiliates are expected to maintain a high standard when representing our brand.
  1. Prohibited Activities (Subject to Change)
  • Any promotion that iTap deems unethical or harmful.
  • Future restrictions may be added at our discretion.


5. Commission Structure & Payment


  1. Commission Rate
  • Affiliates earn 25% of the sale amount for each qualifying referral. This rate is subject to change at iTap’s discretion.
  1. Minimum Payout Threshold
  • Affiliates must accrue at least $100 in commissions before receiving a payout.
  1. Payment Schedule
  • Commissions are disbursed monthly, typically at the end of each month.
  1. Payment Method
  • All payouts are currently made via PayPal.
  • It is the Affiliate’s responsibility to ensure PayPal details are up-to-date.
  1. Tracking & Cookie Duration
  • A 7-day cookie duration applies, meaning that if a referred user makes a purchase within 7 days after clicking the Affiliate Link, the Affiliate is credited with the sale.


6. Term & Termination


  1. Term
  • This Agreement begins when you are approved into the Program and continues until terminated by either party.
  1. Termination by iTap
  • iTap may terminate this Agreement at any time, with or without cause, if we believe you have breached this TOS, engaged in unethical behavior, or otherwise harmed our brand.
  1. Termination by Affiliate
  • You may voluntarily terminate your participation at any time by notifying us via email at support@itapshop.com.
  1. Effects of Termination
  • Upon termination, any outstanding Commission above the minimum threshold will be paid in the next payout cycle unless you were terminated for violating these TOS or engaging in fraudulent or unethical activity, in which case iTap may withhold some or all Commissions.


7. Modification of TOS


  1. Right to Modify
  • We reserve the right to modify or update this TOS at any time, with or without prior notice to Affiliates.
  1. Acceptance of Modifications
  • Your continued participation in the Program after changes to the TOS have been posted or otherwise communicated constitutes your acceptance of those changes.


8. Disclaimer & Limitation of Liability


  1. Disclaimer of Warranties
  • The Program, including all information, tools, and resources provided, is offered on an “as is” and “as available” basis without warranty of any kind.
  1. Limitation of Liability
  • Under no circumstances shall iTap be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the Program.
  • Our total liability for direct damages arising from this TOS will not exceed the total Commissions paid or payable to you under the Program.
  1. No Employment Relationship
  • Nothing in this TOS shall be deemed to create an employment, partnership, or joint venture relationship between iTap and the Affiliate.


9. Governing Law & Dispute Resolution


  1. Governing Law
  • These TOS shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws principles.
  1. Jurisdiction
  • Any disputes arising out of or in connection with this TOS shall be exclusively brought in the courts located in New Jersey.

11. Entire Agreement & Electronic Signature

  • These TOS constitute the entire agreement between you and iTap regarding the Affiliate Program and supersede any prior or contemporaneous agreements.
  1. Electronic Signature
  • By completing the online registration process and/or using the Program, you acknowledge and agree that this TOS forms a legally binding agreement equivalent to a signed contract.


By joining and continuing to participate in the iTap Affiliate Program, you acknowledge that you have read and agree to these Terms of Service.
