LuvBelly Affiliate Program Terms & Conditions

Welcome to the LuvBelly Affiliate Program! By enrolling, you agree to comply with the terms and conditions outlined below. These terms are designed to protect both you as an affiliate and LuvBelly’s brand integrity, ensuring a mutually beneficial partnership.

1. Enrollment in the Program

• Eligibility: To participate, affiliates must be at least 18 years of age.
• Application Process: All affiliate applications are subject to review by LuvBelly. We reserve the right to assess each applicant’s social media accounts and content to ensure alignment with LuvBelly’s values. LuvBelly retains the right to accept or reject any application without providing specific reasons for rejection.

2. Affiliate Responsibilities

• Ethical Promotion: Affiliates must represent LuvBelly’s brand accurately and ethically in all promotional activities. This includes adhering to all legal advertising guidelines and respecting the brand’s values.
• Prohibited Actions: Affiliates must refrain from any behavior or claims that could harm LuvBelly’s reputation. This includes, but is not limited to, making false claims about the product, using spammy promotion tactics, and any activities not approved by LuvBelly. Affiliates agree not to resell LuvBelly’s products or redirect customers to unauthorized channels such as Amazon.

3. Approved Marketing Channels

• Permissible Channels: Affiliates may promote LuvBelly on their personal social media, blogs, and websites.
• Content Restrictions: Affiliates must refrain from unacceptable content, including but not limited to:
• False claims regarding product benefits, such as cures for diseases or ailments.
• Use of profanity or vulgar language.
• Content involving hate speech or discussions about race, religion, or politics.

4. Commission and Payment Terms

• Commission Structure:
• Affiliates earn a stated commission on the initial sale.
• Commissions do apply to recurring orders for the duration of up to 1 year from the date of customers first purchase.
• Affiliates commission and link duration structures may vary.
• LuvBelly reserves the right to keep commission and link duration structures private
• Initial commissions apply to the full “Add to Cart” value.
• Terms Subject to Change: Commission rates and terms are subject to change at any time. Existing affiliate customers and commissions prior to any change will be honored unless an ancillary written agreement is made.
• Payment Details: Payments will be processed according to LuvBelly’s payment schedule and will account for any refunds or fraudulent sales.

5. Cookie Duration

• Tracking: LuvBelly’s affiliate program uses cookies to track referrals for a specified duration, allowing affiliates to earn credit for sales made within this period after a customer clicks the affiliate link.

6. Intellectual Property

• Usage: Affiliates may use LuvBelly’s approved branding materials, including logos, images, copy and content in their promotions, provided that they adhere to brand guidelines ethical practices and stay away from prohibited practices
• Ownership: All intellectual property remains the sole property of LuvBelly, and any usage outside of these guidelines is prohibited.
• Copy Infringement: Affiliates may not reproduce, copy or replicate any products that are associated with LuvBelly or LuvBelly’s product line. Affiliates may not reuse language or verbiage that describes our product to describe other products or their own.

7. Prohibited Activities

• Restricted Practices: Affiliates may not engage in any activity that could damage LuvBelly’s brand image or reputation. Prohibited practices include bidding on LuvBelly brand keywords in paid advertisements, impersonating the brand, or making unverified claims.
• Liability: LuvBelly is not liable for any content, videos, or actions produced by affiliates that were not pre-approved by LuvBelly. Affiliates are responsible for any legal actions or liabilities arising from such activities.
• Consequences: LuvBelly reserves the right to suspend or withhold commissions if affiliates engage in prohibited activities or violate these terms.

8. Termination of Agreement

• Termination by Either Party: Either party may terminate the agreement at any time. Affiliates wishing to terminate their participation should notify LuvBelly in writing or email. LuvBelly will email affiliates if termination occurs.
• Pending Commissions: Upon termination, any pending commissions due will be paid, provided all obligations were met prior to termination.

9. Modification of Terms

• LuvBelly reserves the right to modify these terms at any time. Affiliates will be notified of any changes to terms, which will take effect immediately unless stated otherwise.

10. Disclaimer of Liability

• Affiliate’s Responsibility: Affiliates participate in this program at their own risk. LuvBelly is not liable for any losses or damages incurred by affiliates resulting from participation in the affiliate program. Physical, mental or financial losses are included in this disclaimer.

11. Governing Law

• Jurisdiction: This agreement is governed by the laws of Colorado, USA, and any disputes will be handled in this jurisdiction.
