SwissToniq Geneva Affiliate Program Terms of Service

1. Agreement Overview

This Affiliate Agreement ("Agreement") is made between SwissToniq Geneva ("Company," "we," "us," or "our") and you ("Affiliate," "you," or "your"). This Agreement governs your participation in the SwissToniq Geneva Affiliate Program ("Program").

2. Program Enrollment

2.1. By submitting an application to the Program, you warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding contracts
• All information provided during registration is accurate and current

2.2. We reserve the right to:

• Accept or reject any application at our sole discretion
• Terminate any affiliate account that violates these terms
• Modify the Program terms with reasonable notice

3. Commission Structure

3.1. Commission Rate:

• You will receive 10% commission on qualifying purchases
• Commissions apply to the net purchase amount (excluding taxes and shipping)
• Commissions are earned only on completed, non-refunded purchases
• Company has right to change commission rates at their discretion

3.2. Payment Terms:

• Payments are processed by the 3rd of each month
• Minimum payout threshold may apply
• Commissions are void on cancelled or refunded orders
• Payment processing fees may be deducted from commission payments

4. Affiliate Obligations

4.1. Marketing Guidelines:

• All promotional materials must be truthful and accurate
• You must clearly disclose your affiliate relationship with SwissToniq
• You may only use approved marketing materials and product descriptions
• All content must adhere to our brand guidelines

4.2. Prohibited Activities:

• Bidding on SwissToniq branded terms in paid search
• Using SwissToniq trademarks in domain names
• Making medical claims about our products
• Spamming or using deceptive marketing practices
• Creating fake accounts or generating fraudulent transactions

5. Tracking and Reporting

5.1. Our system will track:

• Clicks through your affiliate links
• Qualified purchases from referred customers
• Commission earnings and payments
• Performance metrics

5.2. You acknowledge that:

• Tracking relies on cookies and proper link formatting
• Technical issues may occasionally affect tracking accuracy
• You must report any discrepancies within 30 days

6. Intellectual Property

6.1. You acknowledge that:

• All SwissToniq trademarks and materials remain our property
• Your use of our materials is limited to Program participation
• You must not modify our materials without permission

6.2. Content Usage:

• You may use approved marketing materials only while actively participating in the Program
• All usage must comply with our brand guidelines
• We may revoke usage rights at any time

7. Term and Termination

7.1. This Agreement:

• Continues until terminated by either party
• May be terminated by us immediately for violations or any other reasons

7.2. Upon termination:

• All rights to use SwissToniq materials cease
• Outstanding commissions will be paid if in good standing
• You must remove all SwissToniq content and links

8. Compliance and Privacy

8.1. You must:

• Comply with all applicable laws and regulations
• Maintain appropriate privacy policies
• Adhere to data protection requirements
• Disclose affiliate relationships as required by law

8.2. Privacy Compliance:

• Handle customer data in accordance with privacy laws
• Not store or misuse customer information
• Follow GDPR and other applicable privacy regulations

9. Limitation of Liability

9.1. We are not liable for:

• Technical issues affecting the Program
• Lost commissions due to tracking errors
• Indirect or consequential damages
• Changes to the Program structure

10. Modifications

10.1. We reserve the right to:

• Modify these terms at any time
• Change commission rates with notice
• Alter Program requirements
• Update tracking systems and methods

11. Governing Law

This Agreement is governed by Swiss law. Any disputes shall be resolved in the courts of Geneva, Switzerland.
