The Love Hundred Affiliate Club Terms and Conditions

1. Agreement

By participating in The Love Hundred Affiliate Club, you agree to be bound by these Affiliate Program Terms and Conditions. "The Love Hundred" refers to the company offering The Love Hundred Affiliate Club, and the terms "affiliate" and "You" refer to the participants in the program. The Love Hundred reserves the right to modify or amend these terms at any time without prior notice.

2. Definitions

• Affiliate: A participant in The Love Hundred Affiliate Club.
• The Love Hundred: Refers to the company offering The Love Hundred Affiliate Club.
• Referral: A customer who makes a purchase on The Love Hundred website through an affiliate's unique tracking link.
• Tracking Link: A unique URL assigned to each affiliate for the purpose of tracking referrals and commissions.
• Commissions: The monetary rewards earned by an affiliate for successful referrals.

3. Eligibility and Sign-Up Process

Affiliates can "Join" The Love Hundred Affiliate Club by filling out the registration form on our designated registration page. To be eligible, affiliates must meet the following criteria:

• Age Requirement: Affiliates must be 18 years of age or older and currently in a loving relationship.
• Social Media Presence: Affiliates should have a significant social media following of 10,000 or more, demonstrating a high level of engagement.
• Engagement with The Love Hundred: Affiliates should have previously engaged with The Love Hundred and are actively spreading the love or planning to.
• Content Creation Skills: Affiliates should possess proficiency as content creators, capable of crafting inspiring content that resonates with their audience.
• Passionate Purpose: Affiliates should showcase a genuine passion for helping others and making a positive impact.

These criteria are essential to ensure that our affiliate club is comprised of individuals who align with our brand's values and mission.

4. Affiliate Responsibilities

• Affiliates must maintain an active and accurate email address with The Love Hundred for program-related communication.
• Affiliates are responsible for promoting The Love Hundred products using approved marketing materials and methods.
• Affiliates must comply with all applicable laws and regulations when promoting The Love Hundred products, including influencer marketing and consumer protection laws.
• Affiliates are not authorized to make any representations or warranties on behalf of The Love Hundred.
• Affiliates must provide truthful and accurate information when promoting The Love Hundred, and they must correct any inaccuracies promptly.
• Affiliates may not use deceptive, misleading, or unethical marketing tactics.
• Affiliates must not engage in spamming or any form of unsolicited communication.
• Affiliates must protect their tracking link and account information from unauthorized access.

5. Commissions and Payouts

• Commissions are awarded to affiliates for successful referrals, and the commission rate will be specified by The Love Hundred.
• Commissions are paid on a monthly payment schedule, which may subject to change.
• Commissions will only be paid for referrals that are tracked through the affiliate's unique tracking link.
• The Love Hundred reserves the right to adjust or cancel commissions for fraudulent or void referrals.
• Commissions are typically paid via PayPal, and payment details must be provided by the affiliate.
• Affiliates must ensure the accuracy of their PayPal email address, as The Love Hundred is not responsible for payment issues resulting from incorrect email addresses.
• Affiliates are also responsible for any PayPal fees associated with receiving their commissions.
• Commissions are contingent on the final, non-refunded and non-cancelled sales. If products or services for which an affiliate has earned commissions are
  refunded or cancelled, the affiliate will lose the corresponding commissions.
• Additionally, The Love Hundred may, at its sole discretion, offer performance bonuses to affiliates for exceptional performance. These bonuses are not guaranteed, and the criteria for awarding them will be determined by The Love Hundred.

6. Tracking Link

• Affiliates will be provided with a unique tracking link to monitor their referrals.
• It is the affiliate's responsibility to ensure that the tracking link is correctly implemented in marketing materials.
• The Love Hundred is not responsible for tracking link errors or omissions.

7. Termination

The Love Hundred reserves the right to terminate an affiliate's participation in the program for any reason, including but not limited to unethical behaviour, violation of these terms, or failure to meetperformance standards.

8. Confidentiality

Affiliates may have access to non-public information about The Love Hundred. This information is confidential and must not be disclosed to third parties.

9. Changes to the Affiliate Program

The Love Hundred reserves the right to make changes to The Love Hundred Affiliate Club, including commission rates, terms, and conditions, at its discretion.

10. Intellectual Property

• Affiliates are granted a limited, non-exclusive license to use approved marketing materials, logos, trademarks, and content provided by The Love Hundred solely for promoting its products and services.
• All intellectual property rights remain the exclusive property of The Love Hundred.
• Affiliates must not engage in any activities that infringe upon the intellectual property rights of The Love Hundred or any third party.
• Affiliates are encouraged to promptly report any instances of infringement involving The Love Hundred's assets or intellectual property.
• Affiliates grand The Love Hundred a perpetual, royalty-free license to use their created content for promoting products. This includes the right to feature the content in paid advertisements and promotional materials. Affiliates waive any proprietary rights over the usage of their content.

11. Compliance with Local Laws

Affiliates are responsible for ensuring that their promotional activities and conduct as part of The Love Hundred Affiliate Club comply with all applicable local, state, and national laws, regulations, and industry standards in their respective jurisdictions. It is the affiliate's duty to be aware of and adhere to any legal requirements that pertain to their promotional activities.

12. Limitation of Liability

The Love Hundred shall not be held liable for any actions, claims, damages, or legal consequences arising from affiliates' conduct, promotional activities, or their failure to comply with legal obligations. Affiliates acknowledge and agree that they are solely responsible for their actions and compliance with all relevant laws.
